SOFTWARE LICENSE AGREEMENT / END USER LICENSE AGREEMENT THIS IS A LEGAL AGREEMENT BETWEEN YOU, THE END USER, AND CYBERPROMOTE GMBH, LIEBIGSTR. 1, 85301 SCHWEITENKIRCHEN, GERMANY. BY INSTALLING THE SOFTWARE YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT CONSENT TO THE TERMS OF THIS AGREEMENT, QUIT THE INSTALLATION AND DELETE THE SOFTWARE FROM YOUR COMPUTER. IF THE TERMS OF THIS AGREEMENT COMPRISE AN OFFER BY CYBERPROMOTE, THEN YOUR ACCEPTANCE IS EXPRESSLY LIMITED TO THE TERMS CONTAINED HEREIN. LICENSE TERMS AND CONDITIONS APPLICABLE TO THE SOFTWARE DIFFDAFF FROM CYBERPRMOTE I. Grant of license Unless otherwise indicated, the software DiffDaff is freeware and permits you to employ as many unaltered copies of the software as you want to. II. Copyright The Software is owned by cyberpromote and/or its licensors and is protected by copyright laws, international treaty provisions, and other national laws. You agree that you have no right, title or interest in the Software, except as set forth in Subsection I. You may - Create unaltered copies of the software - Distribute unaltered copies the software - Offer unaltered copies of the software for download on a web server III. Other restrictions You may not rent or lease the software. You may not sell the software. All download offers pertaining to the software must be provided free and without cost. If you offer DiffDaff for download, a link to the web site(s) www.diffdaff.com and/or to www.cyberpromote.de MUST be provided. IV. No Warranties THE SOFTWARE IS PROVIDED ON AN AS IS BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESSED OR IMPLIED INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES OR CONDITIONS OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Each user of this software is solely responsible for determining the appropriateness of using and distributing the program and assumes all risks associated with its exercise of rights under this agreement, including but not limited to the risks and costs of program errors, compliance with applicable laws, damage to or loss of data, programs or equipment, and unavailability or interruption of operations. V. Advertising / Internet connection ihe software accesses the internet during each startup and displays a web page with apropos information such as available updates and furthermore may contain advertisements. In addition, the files pertaining to the help menu are located on a web server on the internet, which therefore results in the download of these files when the help menu is requested by the user. These additional internet connections may or may not result in augmented fees by the users internet service provider, predicated upon the users service agreement with the aforementioned provider.
